By browsing the site or making a purchase on it, you agree to these terms and conditions. Please read them before using the site or placing an order.

2. Products and Services
Elbé offers, among other things:
original works of art;
art reproductions and prints;
cards, stickers, and other art products;
custom commissions;
murals, collaborations, and cultural outreach activities;
workshops and other artistic services.
Features, dimensions, materials, prices, and availability are listed on each product page, where applicable.
Artwork and handmade products may vary slightly. The colors displayed may also vary depending on the screen, lighting, and settings of the device being used. These variations do not necessarily constitute a defect.
3. Prices and Payment
All prices are listed in Canadian dollars, unless otherwise indicated.
Applicable taxes, shipping costs, and other fees are displayed before the order is confirmed.
Online payments are processed by Stripe or any other payment provider indicated at the time of the transaction. Elbé does not store full credit card numbers.
4. Orders
An order is finalized when the purchase is confirmed in accordance with the website’s ordering process.
The customer must provide accurate and complete information, including their name, shipping address, and contact information. Elbé is not responsible for delays or additional charges resulting from inaccurate information provided by the customer.
If a product becomes exceptionally unavailable after an order is placed, Elbé will contact the customer to propose a solution in accordance with applicable laws.
5. Delivery
The processing and delivery times displayed are estimates. They may vary depending on the destination, the carrier, the time of year, or the nature of the product.
The customer is responsible for verifying the accuracy of the shipping address. Costs incurred due to an incorrect address or an unclaimed package may be billed to the customer, where permitted by law.
For deliveries outside Canada, the customer may be responsible for customs duties, import taxes, or fees charged by the destination country.
6. Original Works
Unless otherwise specified, the purchase of an original artwork includes only the physical object.
The artist retains the copyright and other intellectual property rights associated with the work. The purchase does not confer any right to reproduce, modify, distribute, or commercially exploit the work’s image.
A certificate of authenticity may accompany certain works when indicated on their product page.
7. Reproductions
Reproductions are available in the formats, materials, and options listed on their product page.
A reproduction does not constitute an original work, even when produced in limited quantities or signed. When an edition is limited, the details of the edition are specified on the product listing.
8. Custom Orders and Artistic Services
Custom orders, murals, collaborations, workshops, and other services may be subject to a separate quote, timeline, or contract.
The terms of such a separate contract—including down payments, approval stages, modifications, cancellation, and delivery—take precedence in the event of any conflict with these terms and conditions.
No deposit is considered non-refundable unless clearly stated prior to payment and permitted by law.
9. Returns and Refunds
Returns, exchanges, and refunds are governed by Elbé’s Return and Refund Policy, which forms part of these terms and conditions.
Nothing in these Terms limits the statutory warranties or remedies provided by the Consumer Protection Act or any other applicable law.
10. Intellectual Property
The works, illustrations, photographs, texts, videos, logos, graphic elements, and other content displayed on the website belong to Elbé, the artist, or their respective owners.
They may not be copied, reproduced, modified, published, sold, or used for commercial purposes without prior written authorization.
Sharing a link to the Site or an official Elbé post on social media is permitted, provided that the content is not modified and its source is clearly indicated.
11. Use of the Viewer
The visualizer allows you to generate an approximate simulation of a work within a photograph provided by the user.
The result depends, in particular, on the photograph, perspective, lighting, screen, and the measurements provided. It is a visualization aid and does not constitute an absolute guarantee of the physical result.
Under the viewer’s current operating parameters, the photograph of the room is processed locally within the browser and is not intentionally transmitted to Elbé. If these operating parameters are modified, the Privacy Policy will be updated.
12. External Links and Services
The site may use or contain links to services operated by third parties, including Squarespace, Stripe, shipping carriers, and social media platforms.
Elbé is not responsible for the content or privacy practices of these external services.
13. Site Availability
Elbé strives to keep the site accessible and functional, but does not guarantee continuous or error-free operation.
The Site may be temporarily interrupted for technical, maintenance, or security reasons, or for reasons beyond Elbé’s control.
14. Governing Law
These terms and conditions are governed by the laws of Quebec and the applicable federal laws of Canada.
Any dispute shall be submitted to the competent courts of Quebec, subject to the mandatory rights granted to consumers.
15. Modification of Terms
Elbé may amend these terms and conditions to reflect changes in its business, the website, or legal requirements.
The version applicable to an order is the one presented to the customer at the time of purchase.
