Elbé is committed to protecting the personal information of its customers, visitors, employees, and subscribers.

This policy explains what information may be collected, why it is used, with whom it may be shared, and what rights data subjects have.

2. Information Collected

Depending on how the website is used, Elbé may collect the following information:

Identification and contact information

  • first and last name;

  • email address;

  • phone number;

  • billing or shipping address;

  • company or organization, when applicable.

Order information

  • products purchased;

  • selected formats and options;

  • transaction amount and date;

  • information required for delivery;

  • communications regarding the order;

  • purchase and refund history.

Information Regarding Projects and Services

When a request is made for a custom order, mural, workshop, or collaboration, Elbé may collect information provided regarding the project, including the budget, dimensions, timeline, location, and artistic preferences.

Newsletter-Related Information

Elbé may retain the email address, language of communication, date of consent, and subscription preferences of ElbéClub members.

Technical Information

The website and its providers may collect certain technical information, including:

  • IP address;

  • browser and device type;

  • operating system;

  • pages viewed;

  • the date, time, and approximate duration of visits;

  • links or features used;

  • cookies and similar identifiers that have been authorized.

Payments

Payments are processed by Stripe or another payment provider displayed at the time of purchase.

Elbé does not normally receive or store the full credit card number. Instead, it receives the information necessary to confirm and process the transaction.

3. Art Viewer

As it currently operates, the viewer processes the photograph of the artwork locally within the user’s browser. This photograph is not intentionally uploaded to Elbé’s servers or retained by Elbé.

The file exported by the viewer is created at the user’s request and saved to the location of the user’s choosing on their device.

If the viewer’s operation changes in a way that involves transmitting or storing images, this policy will be updated before that feature is activated.

4. Use of Information

Elbé uses personal information to:

  • process orders and payments;

  • prepare, ship, and deliver products;

  • respond to questions and requests;

  • provide requested services or quotes;

  • manage returns, exchanges, and refunds;

  • administer workshop registrations;

  • send the newsletter with the required consent;

  • prevent fraud and ensure the security of the website;

  • comply with its accounting, tax, and legal obligations;

  • understand how the site is used and improve its services;

  • establish, exercise, or defend a legal right.

Elbé does not sell or rent personal information.

5. Consent

When required by law, Elbé obtains consent before collecting, using, or disclosing personal information.

Consent may be withdrawn, subject to legal or contractual restrictions and reasonable notice. Withdrawal may prevent Elbé from providing certain services, such as processing an order that requires a shipping address.

6. Newsletter and Marketing Communications

Elbé sends marketing communications only when the required consent has been obtained or when another situation authorized by law applies.

Each newsletter includes a way to unsubscribe. A request to unsubscribe may also be sent to atelier.elbe@gmail.com.

Communications necessary for the fulfillment of an order or contract may continue to be sent even after you unsubscribe from promotional communications.

7. Cookies and Similar Technologies

The site uses essential cookies to ensure its proper functioning, including for navigation, the shopping cart, security, language settings, and payment.

With the user’s consent, where required, other cookies may be used to measure audience reach, understand how the site is used, or personalize the user experience.

Preferences can be changed using the site’s cookie management tool. Your browser also allows you to block or delete certain cookies, but some features may no longer function properly as a result.

8. Service Providers

Elbé may share necessary information with service providers that help it operate its business, including:

  • Squarespace, for hosting, the online store, and forms;

  • Stripe, for payment processing;

  • delivery services, including Canada Post;

  • newsletter or email service providers;

  • analytics, security, or technical support providers;

  • accounting, legal, or administrative professionals, when necessary.

These providers receive only the information reasonably necessary to perform their services.

9. Hosting and Processing Outside Quebec

Some providers may store or process information outside of Quebec or Canada.

In such cases, the information may be subject to the laws of the jurisdiction where it is processed. Elbé evaluates the relevant factors and takes reasonable measures to ensure that the information is adequately protected.

10. Retention and Destruction

Elbé retains information only for as long as necessary to fulfill the purposes for which it was collected, as well as to comply with its tax, accounting, contractual, and legal obligations.

When the information is no longer needed, it is securely destroyed or anonymized in accordance with applicable laws.

11. Security Measures

Elbé uses reasonable administrative, technical, and physical measures to protect the information from loss, unauthorized access, disclosure, alteration, or misuse.

However, no method of electronic transmission or storage can guarantee absolute security.

In the event of an incident posing a risk of serious harm, Elbé will take the measures required by law, including notifying the individuals concerned and the Commission d’accès à l’information when required.

12. Rights of Data Subjects

Subject to the exceptions provided for by law, an individual may request:

  • access to personal information concerning them;

  • correction of inaccurate or incomplete information;

  • the withdrawal of their consent;

  • the cessation of the dissemination or de-indexing of certain information, where permitted by law;

  • the disclosure of certain computerized information in a structured and commonly used technological format;

  • information regarding the use and disclosure of their data.

Reasonable verification of identity may be required before responding to a request.

13. Minors

The site is not specifically intended for children under the age of 14.

Elbé does not knowingly collect their personal information without the consent of a parent or guardian when such consent is required.

14. External Sites

The site may contain links to external sites or platforms. Elbé is not responsible for their practices. Users should consult the privacy policy of each external service.

15. Complaints

A complaint regarding the protection of personal information may be submitted to the designated contact person listed at the beginning of this policy.

Elbé will review the complaint and respond within a reasonable time. An individual may also contact the Commission d’accès à l’information du Québec.

16. Policy Amendments

This policy may be amended to reflect changes in Elbé’s activities, the technologies used, or legal obligations.

The date of the last update appears at the beginning of this document. Any significant changes will be appropriately noted on the website.
